These Terms of Service ("Terms") govern your access to and use of dw.fivetoclose.cloud and the Domain Warming service (the "Service") provided by FiveToClose ("we," "us," or "our").
By accessing the Service, creating an account, or subscribing, you agree to these Terms, our Privacy Policy, and Disclaimer. If you do not agree, do not use the Service.
The Service is a subscription-based SaaS tool that helps users warm email-sending domains through automated gradual volume ramps and positive engagement signals. Features include domain ownership verification (via DNS TXT, meta tag, pixel, or CNAME), guidance for SPF/DKIM/DMARC, a dashboard with progress metrics, reputation alerts, and multi-domain management.
The Service is provided "as is" and "as available." We do not control or guarantee outcomes from your subsequent email sending activities.
Access requires sign-in with Google (OAuth). You must provide accurate information and are responsible for all activity under your account. After login we prompt you to set up 2FA (TOTP) for additional security. You must keep your account credentials and 2FA secrets secure. Notify us immediately of any unauthorized use.
Subscriptions are offered on a per-domain monthly ($19) or annual ($179) basis and are managed exclusively through Stripe. Adding additional domains incurs additional per-domain charges. You may upgrade, downgrade, add, or remove domains at any time through the dashboard.
Billing occurs automatically via Stripe. You can cancel or manage your subscription at any time via the Service dashboard or your Stripe customer portal. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial periods except where required by law or as explicitly offered.
All prices are in USD and subject to applicable taxes.

We make no guarantees, warranties, or representations regarding email deliverability, inbox placement rates, domain reputation scores, sender reputation, open rates, or any other performance metrics.
Domain warming is an assistive process based on industry best practices. Final email performance depends on numerous factors outside our control, including your sending volume and cadence, email content and design, list quality and engagement history, recipient complaints, ISP and mailbox provider policies, and broader internet conditions.
Any progress metrics, estimated inbox rates, or alerts shown in the dashboard are illustrative estimates only and are not promises of future results.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for abusive or unlawful purposes.
The Service, including all software, design, dashboard, documentation, and branding, is owned by FiveToClose or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your own legitimate purposes during your active subscription. You may not copy, modify, or create derivative works of the Service.
To the maximum extent permitted by law, FiveToClose, its affiliates, and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages.
Our total aggregate liability under these Terms shall not exceed the total fees you paid to us for the Service in the twelve (12) months preceding the claim.
The Service is provided without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any data or results will be accurate or reliable.
You agree to indemnify and hold harmless FiveToClose and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your domains, your email sending practices, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including liability limitations and intellectual property) will survive.
These Terms are governed by the laws of the United States and the State of applicable jurisdiction, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in that jurisdiction.
We may modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes are effective constitutes acceptance of the revised Terms.
